1. Our Commitment
SellStein respects the intellectual property rights of others and expects our merchants and users to do the same. We respond to valid notices of alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act (17 U.S.C. § 512), the EU Copyright Directive (2019/790), and equivalent international copyright frameworks.
As a technology platform provider, SellStein hosts merchant content but does not control, endorse, or pre-screen individual product listings or merchant content. We rely on rights holders to notify us of potential infringements.
2. Filing a DMCA Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and believe that content hosted on SellStein infringes your copyright, you may submit a DMCA takedown notice containing the following information:
- Identification of the copyrighted work: A description of the copyrighted work you claim is being infringed, or a representative list if multiple works are involved.
- Identification of the infringing material: The specific URL(s) or sufficient information to locate the allegedly infringing content on our platform.
- Your contact information: Your full name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Signature: Your physical or electronic signature.

3. Our Response Process
Upon receiving a valid DMCA takedown notice, we will:
- Review the notice for completeness and validity
- Promptly remove or disable access to the allegedly infringing content
- Notify the merchant/user who posted the content ("alleged infringer") that the content has been removed
- Provide the alleged infringer with a copy of the takedown notice and information about their right to file a counter-notice
We aim to process valid takedown notices within 2 business days of receipt.
4. Counter-Notification
If your content was removed due to a DMCA takedown notice and you believe the removal was in error or that you have authorization to use the content, you may file a counter-notification containing:
- Identification of the removed material: Description and URL where the material appeared before removal.
- Statement under penalty of perjury: A statement that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Consent to jurisdiction: Your consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the US, any judicial district in which SellStein may be found), and that you will accept service of process from the person who submitted the takedown notice.
- Your contact information: Full name, address, phone number, email.
- Signature: Physical or electronic signature.
Send counter-notifications to dmca@sellstein.com with the subject line "DMCA Counter-Notification."
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a federal court action within 10–14 business days, we will restore the removed content.
5. Repeat Infringer Policy
SellStein maintains a policy of terminating accounts of users who are repeat infringers of copyright. We consider a user a repeat infringer if:
- They have received three (3) or more valid DMCA takedown notices
- They have not successfully contested the notices via counter-notification
- The notices involve different copyrighted works
Account termination for repeat infringement is at our sole discretion, considering all relevant circumstances.
6. Misrepresentation Warning
Please be aware that knowingly submitting a false or fraudulent DMCA notice or counter-notification may result in legal liability. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorneys' fees.
Before submitting a DMCA notice, please ensure that you are the copyright owner (or authorized agent) and that the use of the content does not constitute fair use or another legitimate defense.
7. International Copyright Claims
While the DMCA is a U.S. statute, we also respond to copyright infringement claims under:
- EU Copyright Directive (Directive 2019/790)
- UK Copyright, Designs and Patents Act 1988
- Berne Convention for the Protection of Literary and Artistic Works
- WIPO Copyright Treaty
- Other applicable national copyright laws
International copyright claims should follow the same general format as a DMCA notice and be sent to dmca@sellstein.com.
