Trademark Policy

SellStein respects the trademark rights of others and expects our merchants to do the same. We respond to valid reports of trademark infringement and take appropriate action to remove infringing content from our platform.

Trademark infringement on the SellStein platform may include, but is not limited to:

• Using a registered trademark or confusingly similar mark in product listings, store names, or descriptions without authorization
• Selling counterfeit goods bearing another party's trademark
• Using another party's trademark in a way that is likely to cause confusion about the origin, sponsorship, or affiliation of products or services
• Using brand names, logos, or trade dress in domain names, store names, or metadata to mislead consumers

Note: Not all uses of a trademark constitute infringement. Nominative fair use (e.g., "Compatible with [Brand]"), comparative advertising, commentary, and parody may be protected under applicable law.

If you are a trademark owner (or authorized representative) and believe that content on SellStein infringes your trademark rights, please submit a report containing:

1. Your trademark details: The trademark word mark or description of the design mark, registration number (if registered), the jurisdiction of registration, and the goods/services covered.
2. Identification of the infringing content: Specific URL(s) or description of the content you believe infringes your trademark, with an explanation of how it creates a likelihood of confusion.
3. Your contact information: Full name, company/organization, mailing address, email, and phone number.
4. Statement of authority: A statement that you are the trademark owner or authorized to act on behalf of the trademark owner.
5. Good faith statement: A statement that you have a good faith belief that the use of the trademark is not authorized and constitutes infringement.
6. Signature: Physical or electronic signature.

Upon receiving a trademark infringement report, we will:

1. Review the report for completeness and validity
2. Assess the alleged infringement, considering the likelihood of confusion and potential fair use defenses
3. If the report is substantiated, remove or disable the infringing content
4. Notify the affected merchant and provide them with the details of the report and their right to respond

We aim to respond to complete reports within 5 business days. Complex cases may require additional time for review.

If your content or store was affected by a trademark infringement report, you may submit a response explaining why you believe the use does not constitute infringement. Your response should include:

• Your full name and contact information
• Identification of the content at issue
• A detailed explanation of why the use is not infringing (e.g., you have authorization, fair use, the products are genuine)
• Any supporting documentation (authorization letters, purchase receipts for genuine goods, etc.)

SellStein maintains a zero-tolerance policy for the sale of counterfeit goods. If we determine that a merchant is selling counterfeit products:

• The infringing products will be immediately removed
• The merchant's account may be suspended or terminated without prior notice
• We may share information about the merchant with the trademark owner or law enforcement as permitted by applicable law
• Repeat offenders will be permanently banned from the platform

The following are trademarks of MD SOFTWARE L.L.C-FZ and Fluxera LLC:

• "SellStein" (word mark)
• The SellStein logo and design marks
• "SellStein Commerce"

You may not use SellStein trademarks without our prior written permission, except for truthful, non-misleading references to the platform (e.g., "Powered by SellStein"). Any authorized use must follow our brand guidelines.

Knowingly submitting a false or fraudulent trademark infringement report may result in legal liability. Before filing a report, ensure that you are the trademark owner or authorized to act on their behalf, and that the use you are reporting constitutes actual infringement and not protected fair use.
